Note on data transfer to third countries that are not secure under data protection law, such as transfer to US companies that are not DPF-certified

We use tools from companies based in third countries that are not secure under data protection law, as well as US tools whose providers are not certified under the EU-US Data Privacy Framework (DPF). When these tools are active, your personal data may be transferred to these countries and processed there. We would like to point out that a level of data protection comparable to that in the EU cannot be guaranteed in third countries that are not secure under data protection law.

We would like to point out that the USA, as a safe third country, generally has a level of data protection comparable to that of the EU. Data transfers to the USA are therefore permissible if the recipient has certification under the EU-US Data Privacy Framework (DPF) or has appropriate additional safeguards in place. Information on transfers to third countries, including the recipients of the data, can be found in this privacy policy.

Recipients of personal data

We work with various external parties in the course of our business activities. This sometimes requires the transfer of personal data to these external parties. We only pass on personal data to external parties if this is necessary for the fulfilment of a contract, if we are legally obliged to do so (e.g. disclosure of data to tax authorities), if we have a legitimate interest in the disclosure in accordance with Art. 6 para. 1 lit. f GDPR, or if another legal basis permits the disclosure of data. When using processors, we only pass on personal data of our customers on the basis of a valid contract for order processing. In the event of joint processing, a joint processing agreement is concluded.

The company is certified under the EU-US Data Privacy Framework (DPF). The DPF is an agreement between the European Union and the USA that aims to ensure compliance with European data protection standards when data is processed in the USA. Every company certified under the DPF undertakes to comply with these data protection standards. ·        If you have lodged an objection pursuant to Art. 21 (1) GDPR, a balance must be struck between your interests and ours. As long as it is not yet clear whose interests prevail, you have the right to request the restriction of the processing of your personal data.

4. Data collection on this website

Cookies

Our websites use so-called "cookies". Cookies are small data packets and do not cause any damage to your device. They are either stored temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your device. Session cookies are automatically deleted at the end of your visit. Permanent cookies remain stored on your device until you delete them yourself or they are automatically deleted by your web browser.

Cookies may originate from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services from third-party companies within websites (e.g. cookies for processing payment services).

Cookies have various functions. Numerous cookies are technically necessary because certain website functions would not work without them (e.g. the shopping basket function or the display of videos). Other cookies may be used to evaluate user behaviour or for advertising purposes.

Cookies that are necessary for the electronic communication process, for the provision of certain functions you have requested (e.g. for the shopping basket function) or for the optimisation of the website (e.g. cookies for measuring the web audience) (necessary cookies) are stored on the basis of Art. 6 para. 1 lit. f GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimised provision of its services. If consent to the storage of cookies and similar recognition technologies has been requested, processing will take place exclusively on the basis of this consent (Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG); consent can be revoked at any time.

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be restricted.

You can find out which cookies and services are used on this website in this data protection declaration.

We use the consent management platform "One Trust" from OneTrust Technology Limited, 82 St. John Street, London, England, EC 1M 4JN. This service enables us to obtain and manage the consent of website users for data processing.

device information,

browser information,

anonymised IP address,

opt-in and opt-out data,

Date and time of visit,

Request URLs of the website,

The consent status is also stored in the end user's browser so that the website can automatically read and comply with the end user's consent for all subsequent page requests and future end user sessions for up to 12 months. The consent data (consent and withdrawal of consent) will be stored for three years. The storage period corresponds to the regular limitation period in accordance with Section 195 of the German Civil Code (BGB). The data will then be deleted immediately.

The functionality of the website cannot be guaranteed without the processing described. The user has no right to object as long as there is a legal obligation to obtain the user's consent to certain data processing operations, Art. 7 para. 1, 6 para. 1 sentence 1 lit. c GDPR.

Further information about One Trust can be found at: https://www.onetrust.de/datenschutzerklaerung/.

If you send us enquiries via the contact form, your details from the enquiry form, including the contact details you provided there, will be stored by us for the purpose of processing the enquiry and in the event of follow-up questions. We will not pass on this data without your consent.

The processing of this data is based on Art. 6 para. 1 lit. b GDPR, provided that your request is related to the fulfilment of a contract or is necessary for the implementation of pre-contractual measures. The data you send us via contact enquiries will remain with us until you request us to delete it, revoke your consent to its storage or the purpose for data storage no longer applies (e.g. after your enquiry has been processed). Mandatory legal provisions – in particular statutory retention periods – remain unaffected.

Communication via WhatsApp

We use the instant messaging service WhatsApp, among other things, to communicate with our customers and other third parties. The provider is WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

Communication takes place via end-to-end encryption (peer-to-peer), which prevents WhatsApp or other third parties from accessing the content of the communication. However, WhatsApp has access to metadata generated during the communication process (e.g. sender, recipient and time). We would also like to point out that WhatsApp, according to its own statement, shares personal data of its users with its parent company Meta, which is based in the USA. Further details on data processing can be found in WhatsApp's privacy policy at: https://www.whatsapp.com/legal/#privacy-policy.

If consent has been requested, data processing will only take place on the basis of this consent; this consent can be revoked at any time with future effect.

Mandatory legal provisions – in particular retention periods – remain unaffected.

The company is certified under the EU-US Data Privacy Framework (DPF). The DPF is an agreement between the European Union and the USA that aims to ensure compliance with European data protection standards when data is processed in the USA. We have set up our WhatsApp accounts so that there is no automatic data synchronisation with the address book on the smartphones in use.

We have concluded a data processing agreement (DPA) with the above-mentioned provider.

5. Social media

Social media elements with Flockler

On our websites, we use the services of Flockler, a limited liability company based at Rautatienkatu 21 B, 33100, Tampere, Finland.

Flockler offers the use of a social media wall. This brings together our own and third-party social media content in a "wall" available on our website. On the one hand, this serves the economic purpose of social media, while on the other hand ensuring the protection of personal data. A connection to the respective social media providers is only established when you actively click on the post, which redirects you to the social media provider. Through your interactions with the social media posts on the "wall", data may be transmitted to the respective service and interactions may be assigned to your profile, provided that you are registered with a social media service. According to its own information, Flockler itself does not store any information about your visit, but it does have access to your IP address in order to display the "wall".

These processing operations are carried out on the basis of our legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR.

Detailed information about Flockler can be found at: https://flockler.com/privacy-policy.

6. Analysis tools and advertising

Google

This website uses functions of the web analytics service Google Analytics. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics enables the website operator to analyse the behaviour of website visitors. The website operator receives various usage data, such as page views, length of stay, operating systems used and the origin of the user. This data is aggregated in a user ID and assigned to the respective end device of the website visitor.

Furthermore, we can use Google Analytics to record your mouse and scroll movements and clicks, among other things. Google Analytics also uses various modelling approaches to supplement the data sets collected and uses machine learning technologies in data analysis.

Google Analytics uses technologies that enable the recognition of users for the purpose of analysing user behaviour (e.g. cookies or device fingerprinting). The information collected by Google about the use of this website is usually transferred to a Google server in the USA and stored there.

The use of this service is based on your consent in accordance with Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG. Consent can be revoked at any time.

Data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://privacy.google.com/businesses/controllerterms/mccs/.

The company is certified under the EU-US Data Privacy Framework (DPF). The DPF is an agreement between the European Union and the USA that aims to ensure compliance with European data protection standards when processing data in the USA. Every company certified under the DPF undertakes to comply with these data protection standards. Further information on this can be obtained from the provider at the following link: https://www.dataprivacyframework.gov/s/participant-search/participant-detail?contact=true&id=a2zt000000001L5AAI&status=Active

Google is required by the Digital Markets Act to obtain user consent before processing user data for personalised advertising. Google complies with this requirement through its "Consent Mode". Users are required to implement this mode and thus demonstrate that they have obtained the consent of website visitors.

Google offers two implementation modes: simple and advanced.

We use the simple implementation method of Google Consent Mode. Only if you give your consent to the use of Google Analytics (see above) will a connection to Google be established, a Google code executed and the processing described above carried out. If you refuse to give your consent, Google will only receive information that consent has not been given. The Google code will not be executed and no Google Analytics cookies will be set.

Browser plugin

You can prevent Google from collecting and processing your data by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de.

For more information on how Google Analytics handles user data, please refer to Google's privacy policy: https://support.google.com/analytics/answer/6004245?hl=de.

Google Signals

We use Google Signals. When you visit our website, Google Analytics collects, among other things, your location, search history and YouTube history, as well as demographic data (visitor data). This data can be used for personalised advertising with the help of Google Signal. If you have a Google account, the visitor data from Google Signal is linked to your Google account and used for personalised advertising messages. The data is also used to create anonymous statistics about the user behaviour of our users.

Order processing

We have entered into a contract with Google for order processing and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Google Analytics e-commerce measurement

This website uses the "e-commerce measurement" function of Google Analytics. With the help of e-commerce measurement, the website operator can analyse the purchasing behaviour of website visitors in order to improve its online marketing campaigns. This includes information such as orders placed, average order values, shipping costs and the time from viewing to purchasing a product. This data can be aggregated by Google under a transaction ID that is assigned to the respective user or their device.

Google Ads

The website operator uses Google Ads. Google Ads is an online advertising programme provided by Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Ads enables us to display advertisements in the Google search engine or on third-party websites when the user enters certain search terms in Google (keyword targeting). Furthermore, targeted advertisements can be displayed based on user data available to Google (e.g. location data and interests) (target group targeting). As the website operator, we can evaluate this data quantitatively, for example by analysing which search terms led to the display of our advertisements and how many advertisements led to corresponding clicks.

The use of this service is based on your consent in accordance with Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG. Consent can be revoked at any time.

Data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://policies.google.com/privacy/frameworks and https://privacy.google.com/businesses/controllerterms/mccs/.

The company is certified under the EU-US Data Privacy Framework (DPF). The DPF is an agreement between the European Union and the USA that aims to ensure compliance with European data protection standards when data is processed in the USA. Every company certified under the DPF undertakes to comply with these data protection standards. Further information on this can be obtained from the provider at the following link: https://www.dataprivacyframework.gov/s/participant-search/participant-detail?contact=true&id=a2zt000000001L5AAI&status=Active.

Google Ads Remarketing

This website uses the functions of Google Ads Remarketing. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

With Google Ads Remarketing, we can assign people who interact with our online offering to specific target groups in order to subsequently display interest-based advertising to them in the Google advertising network (remarketing or retargeting).

LinkedIn Insight Tag

This website uses the Insight Tag from LinkedIn. The provider of this service is LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland.

Data processing by LinkedIn Insight Tag

With the help of the LinkedIn Insight Tag, we receive information about visitors to our website. If a website visitor is registered with LinkedIn, we can analyse, among other things, the key professional data (e.g. career level, company size, country, location, industry and job title) of our website visitors and thus better tailor our site to the respective target groups. Furthermore, with the help of LinkedIn Insight Tags, we can measure whether visitors to our websites make a purchase or take other actions (conversion measurement). Conversion measurement can also be carried out across devices (e.g. from PC to tablet). LinkedIn Insight Tag also offers a retargeting function that allows us to display targeted advertising to visitors to our website outside the website, whereby, according to LinkedIn, no identification of the advertising recipient takes place.

LinkedIn itself also collects so-called log files (URL, referrer URL, IP address, device and browser properties, and time of access). IP addresses are shortened or (if used to reach LinkedIn members across devices) hashed (pseudonymised). The direct identifiers of LinkedIn members are deleted by LinkedIn after seven days. The remaining pseudonymised data is then deleted within 180 days.

As the website operator, we cannot assign the data collected by LinkedIn to specific individuals. LinkedIn will store the personal data collected from website visitors on its servers in the United States and use it for its own advertising purposes. For details, please refer to LinkedIn's privacy policy at https://www.linkedin.com/legal/privacy-policy#choices-oblig.

If consent has been obtained, the use of the above-mentioned service is based exclusively on Art. 6 para. 1 lit. a GDPR and § 25 TTDSG. Consent can be revoked at any time. If no consent has been obtained, the use of this service is based on Art. 6 para. 1 lit. f GDPR; the website operator has a legitimate interest in effective advertising measures, including social media.

Furthermore, LinkedIn members can control the use of their personal data for advertising purposes in their account settings. To prevent LinkedIn from linking data collected on our website to your LinkedIn account, you must log out of your LinkedIn account before visiting our website.

7. Newsletter

Newsletter data

If you would like to receive the newsletter offered on the website, we need your email address and information that allows us to verify that you are the owner of the email address provided and that you agree to receive the newsletter. Further data will not be collected or will only be collected on a voluntary basis. We use newsletter service providers, which are described below, to process the newsletter.

Mailchimp

This website uses the services of Mailchimp to send newsletters. The provider is Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA.

Mailchimp is a service that can be used to organise and analyse the sending of newsletters, among other things. If you enter data for the purpose of receiving the newsletter (e.g. email address), this data will be stored on Mailchimp's servers in the USA.

Mailchimp enables us to analyse our newsletter campaigns. When you open an email sent by Mailchimp, a file contained in the email (known as a web beacon) connects to Mailchimp's servers in the USA. This allows us to determine whether a newsletter message has been opened and which links, if any, have been clicked on. Technical information is also collected (e.g. time of retrieval, IP address, browser type and operating system). This information cannot be assigned to the respective newsletter recipient. It is used exclusively for statistical analysis of newsletter campaigns. The results of these analyses can be used to better tailor future newsletters to the interests of the recipients.

If you do not want Mailchimp to analyse your data, you must unsubscribe from the newsletter. We provide a link for this purpose in every newsletter message.

Data processing is based on your consent (Art. 6 para. 1 lit. a GDPR). You can revoke this consent at any time by unsubscribing from the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.

The data you provide us with for the purpose of receiving the newsletter will be stored by us until you unsubscribe from the newsletter or the newsletter service provider, and will be deleted from the newsletter distribution list after you unsubscribe from the newsletter. Data stored by us for other purposes remains unaffected by this.

Data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://mailchimp.com/eu-us-data-transfer-statement/ and https://mailchimp.com/legal/data-processing-addendum/#Annex_C_-_Standard_Contractual_Clauses.

After you unsubscribe from the newsletter distribution list, your email address will be stored by us or the newsletter service provider in a blacklist if necessary to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be merged with other data. This serves both your interests and our interests in complying with the legal requirements for sending newsletters (legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR). Storage in the blacklist is not limited in time. You can object to storage if your interests outweigh our legitimate interest.

We use online conference tools, among other things, to communicate with our customers. The specific tools we use are listed below. If you communicate with us via video or audio conference over the Internet, your personal data will be collected and processed by us and the provider of the respective conference tool.

The conference tools collect all data that you provide/use to use the tools (e-mail address and/or your telephone number). Furthermore, the tool provider processes all technical data required for the processing of online communication. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or loudspeaker, and the type of connection.

If content is exchanged, uploaded or made available in any other way within the tool, it will also be stored on the tool provider's servers. Such content includes, in particular, cloud recordings, chat/instant messages, voice mails, uploaded photos and videos, files, whiteboards and other information shared during the use of the service.

Please note that we do not have full control over the data processing operations of the tools used. Our options are largely determined by the company policy of the respective provider. 11. Own services

Handling of applicant data

We offer you the opportunity to apply for a job with us (e.g. by email, post or via our online application form). Below, we inform you about the scope, purpose and use of your personal data collected during the application process. We assure you that the collection, processing and use of your data will be carried out in accordance with applicable data protection law and all other legal provisions and that your data will be treated as strictly confidential.

Scope and purpose of data collection

When you send us an application, we process your associated personal data (e.g. contact and communication data, application documents, notes made during job interviews, etc.) to the extent necessary to decide whether to establish an employment relationship. The legal basis for this is Section 26 of the German Federal Data Protection Act (BDSG) (initiation of an employment relationship), Article 6(1)(b) of the GDPR (general contract initiation) and – if you have given your consent – Article 6(1)(a) of the GDPR. Consent can be revoked at any time. Your personal data will only be passed on within our company to persons involved in processing your application.

If your application is successful, the data you submit will be stored in our data processing systems on the basis of Section 26 BDSG and Art. 6 (1) lit. b GDPR for the purpose of implementing the employment relationship.

Retention period of data

If we are unable to offer you a position, you decline a job offer or withdraw your application, we reserve the right to store the data you have provided on the basis of our legitimate interests (Art. 6 para. 1 lit. f GDPR) for up to 6 months from the end of the application process (rejection or withdrawal of the application). The data will then be deleted and the physical application documents destroyed. The storage serves in particular for verification purposes in the event of a legal dispute. If it is apparent that the data will be required after the expiry of the 6-month period (e.g. due to an impending or pending legal dispute), deletion will only take place when the purpose for further storage no longer applies.

Longer storage may also take place if you have given your consent (Art. 6 para. 1 lit. a GDPR) or if statutory retention obligations prevent deletion.

Inclusion in the applicant pool

If we do not offer you a position, we may include you in our applicant pool. If you are included, all documents and information from your application will be transferred to the applicant pool so that we can contact you if a suitable vacancy arises.

Inclusion in the applicant pool is based exclusively on your express consent (Art. 6 para. 1 lit. a GDPR). The provision of consent is voluntary and is not related to the current application process. The data subject may revoke their consent at any time. In this case, the data will be irrevocably deleted from the applicant pool, unless there are legal reasons for retention.

The data from the applicant pool will be irrevocably deleted no later than two years after consent has been given.

Our social media presence

Data processing by social networks

We maintain publicly accessible profiles on social networks. The specific social networks we use are listed below.

Social networks such as Facebook, Twitter, etc. can generally analyse your user behaviour comprehensively when you visit their website or a website with integrated social media content (e.g. like buttons or advertising banners). When you visit our social media sites, numerous data processing operations relevant to data protection are triggered. In detail:

If you are logged into your social media account and visit our social media presence, the operator of the social media portal can assign this visit to your user account. However, your personal data may also be collected if you are not logged in or do not have an account with the respective social media portal. In this case, this data is collected this case, for example, via cookies stored on your device or by recording your IP address.

With the help of the data collected in this way, the operators of the social media portals can create user profiles in which your preferences and interests are stored. In this way, interest-based advertising can be displayed to you both within and outside the respective social media presence. If you have an account with the respective social network, the interest-based advertising can be displayed on all devices on which you are logged in or have been logged in .

Please also note that we cannot track all processing operations on the social media portals. Depending on the provider, further processing operations may therefore be carried out by the operators of the social media portals. For details, please refer to the terms of use and privacy policies of the respective social media portals.

Legal basis

Our social media presence is intended to ensure the most comprehensive presence possible on the Internet. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR. The analysis processes initiated by the social networks may be based on different legal bases, which must be specified by the operators of the social networks (e.g. consent within the meaning of Art. 6 para. 1 lit. a GDPR).

Responsible party and assertion of rights

If you visit one of our social media sites (e.g. Facebook), we are jointly responsible with the operator of the social media platform for the data processing operations triggered during this visit. You can assert your rights (information, correction, deletion, restriction of processing, data portability and complaint) in principle both against us and against the operator of the respective social media portal (e.g. vis-à-vis Facebook).

Please note that despite our joint responsibility with the social media portal operators, we do not have complete control over the data processing operations of the social media portals. Our options are largely determined by the company policy of the respective provider.

Storage period

The data collected directly by us via our social media presence will be deleted from our systems as soon as the purpose for its storage no longer applies, you request us to delete it, you revoke your consent to its storage or the purpose for data storage no longer applies. Stored cookies remain on your device until you delete them. Mandatory legal provisions – in particular retention periods – remain unaffected.

We have no influence on the storage period of your data stored by the operators of social networks for their own purposes. For details, please contact the operators of the social networks directly (e.g. in their privacy policy, see below).
